This page is meant to assist anyone looking to adopt but especially gay couples considering adoption and looking for resources in their area. I remember how little information there was when we first began our search. We had to rely on word of mouth.
This is meant to be a living document and is by no means complete. If you know of any additional agencies freindly to gay adoption or can warn us against any on the list, let us know so we can update this information and keep it as accurate as possible. We understand that the laws are shifting as some states now allow gay marriage, which changes the adoption landscape. Let us know if you find gay friendly agencies we can add to our list.
Please do not be discouraged if you can't find anyone in your area, this list is still growing and its always possible an agency in a neighboring area can direct you to an agency in your area. Dont give up! Thats how it worked for us.
We hope you can begin building your family here.
First, some definitions:
Single (Individual) Adoption:
An adoption where an unmarried person seeks to adopt a child that has been put for adoption by the birth parent(s) or by the State.
Joint Adoption:
An adoption in which an unmarried couple seeks to adopt a child that has been put up for adoption by the birth parent(s) or by the State.
Second-parent Adoption:
An adoption in which one parent already has legal rights of the child and a second parent is petitioning for joint rights. The first parent does not give up parental rights. Gay couples in states that do not allow joint same-sex adoption can choose this option.
Step-parent (Domestic Partner) Adoption:
An adoption in which a child is already living with both same-sex parents, step-parent or domestic partner adoption is filed.
Guardianship:
Where gay adoption is not legal, parents can protect their families by applying for guardianship. However, guardianship does not provide the same legal rights as adoption.
Foster Care vs. Adoption(Fostadopt):
Foster care differs from adoption in a few ways. A foster parent assumes care responsibility for the foster child, but the State maintains all legal guardianship of the child. Adoption transfers legal responsibility and care over to the adopting parents. In some states like California, any parent wishing to adopt a child placed for adoption by the state must first be registered as a foster parent. This is known as Fostadopt. This does not extend to private adoptions.
